The ABLE Network Terms and Conditions

 

  1. All products and produce ordered are subject to availability.

 

  1. ABLE retains the right to change prices as market conditions and product availability changes.

 

  1. ABLE retains the right to change suppliers when market conditions change.

 

  1. ABLE retains the right to change any of its product name or vendor to a product name or vendor of another name, as long as the product is of an equal or better quality.

 

  1. ABLE will provide the customer another product that it has determined to be of equal value, should a product not be available after you have placed your order. If a product of equal value is not available, ABLE will either issue a refund, or provide the customer the opportunity to select another product.

 

  1. Customer is responsible for supplying ABLE the correct customer information when orders are made. Customers must notify their POC or an ABLE customer service representative within 72 hours of any inaccuracies in the ordering process. ABLE will put forth its best effort to correct the problem. Should a correction not be possible, customer understands that ABLE has no liability beyond a refund of the product within 10 days of purchase.

 

  1. Customer understands that each city is required to meet a minimum ABLE pallet purchase BEFORE products are shipped to a city. Customer should contact the Local ABLE POC for the status of the city order.

 

  1. Customer agrees to pick up order at the DESIGNATED pickup location during the PUBLICIZED times and date. Should customer have a challenge with the announced pickup time, customer will CONTACT the Local ABLE POC, in a timely fashion, and attempt to make an alternative arrangement, if possible. Customer agrees that should alternative arrangements not be possible, customer may FORFEIT their purchase.

 

  1. Home Delivery customers will be contacted prior to an order being delivered. Should customer not respond to any attempts to make contact, Home Delivery will not occur. Home Delivery orders will NOT be left at customer’s home without customer signature. Should Home Delivery not occur, customer agrees to pick up the order at the DESIGNATED pickup location during the PUBLICIZED times and date. Customer agrees that should Home Delivery attempts be unsuccessful and failure to pickup order during the PUBLICIZED times and date, customer may FORFEIT their purchase.

 

  1. Customer signature, or signature of authorized representative, is required when pickup occurs at the DESIGNATED pickup location during the PUBLICIZED times and date, or Home Delivery, or possible rescheduled pickup arrangements. Customer agrees to have received their complete ABLE order and ALL items in the order are frozen and/or in excellent condition.

 

  1. No ABLE products or produce are to be resold, wholly or in part, without written authorization of ABLE Network, Inc.

 

  1. Customer agrees that should a dispute arise with ABLE, the first remedy will be arbitration amongst the parties. Customer agrees that the American Legal System will be the last resort, and only used if all else fails. Customer and ABLE agree they will accept the decision of an independent arbitrator.
